Management Liability Policy for healthcare professionals

For those who practice in the healthcare sector, exposure to risk is a constant concern. Our Total Healthcare Professionals Management Liability Policy is designed to provide breadth and depth of cover for the unique risks that healthcare professionals are exposed to, whilst being competitively priced.

We understand the deficiencies that all too often exist within 'typical' insurance policies - so our Management Liability Policy is specifically designed to respond to the risks to which healthcare practices are commonly exposed. The policy has been co-authored by leading healthcare lawyers and AXA, a leader in insurance.

The policy is designed to help protect practices from risks, including:

  • NHS claw backs;
  • CQC inspections and problems arising;
  • partnership disputes;
  • provider companies – shareholder issues;
  • employment disputes; and
  • health and safety investigations.

Not to be confused with Legal Expenses Insurance, often sold as an add-on to commercial insurance, the policy also includes:

  • Sole Practitioners’, Partners’, Directors’ and Officers’ Liability – claims brought in connection with the running of a business;
  • Employment Practices Liability – with a £nil excess if the advice line is used – as opposed to a typical excess of c. £3,000;
  • Company Legal Liability – claims made in connection with the running of a company; and
  • no “prospect of success” clause, unlike the majority of Legal Expenses policies.

Having the peace of mind that you have appropriate insurance policies and risk management procedures in place to protect you and your practice is vital – and the assurance that you are benefiting from the experience of experts in your sector is invaluable.

For more information about the specific covers the policy includes please get in touch.

Agricultural Machinery Dealers

Specialist insurance for agricultural and horticultural machinery dealers

Modern agriculture demands efficient, cost-effective management of all of the resources associated with farming. This is particularly true in the context of agricultural machinery which can account for a high proportion of the fixed costs associated with agricultural businesses.

Machinery dealers need peace of mind that the insurance cover they have in place provides quality business insurance solutions.

Lucas Fettes is pleased to provide an exclusive specialist insurance package for Agricultural Machinery Dealers. Agshield is a comprehensive package of covers providing appropriate business insurance solutions and is underwritten by AXA, one of the UK's premier insurers.

Many standard insurance policies include a number of add-ons that offer little or no benefit to you or your business, which can result in you paying for cover that is not relevant to your requirements. With Agshield you can be assured that we have specifically researched the requirements of Agricultural Machinery Dealers to ensure that the cover we provide is both adequate and relevant to your needs.

Food & Drink

When mistakes can make or break your reputation, you need to plan for the worst.

Food and drink is a sector in which small mistakes can result in high profile incidents. Whether you’re a manufacturer, wholesaler or retailer, how you manage an incident can make or break your reputation and potentially the entirety of the business as a consequence – particularly given the tough marketplace in which you operate and the uncertainty created by Brexit. Understanding the risks you face and putting in place a strategy to manage and mitigate those risks is part of the process of planning ahead, as the Elliott Report¹ demonstrated.

 Specialist expertise at an attainable cost

A proactive risk identification process and strategic risk management are time consuming and traditionally considered to be expensive; an unattainable luxury to smaller businesses. But mistakes can be just as damaging, if not more so, to smaller businesses. Our solutions combine various risk management, insurance and employee benefits services to give you the right protection and peace of mind at the right price. We take a consultative approach to the technical, commercial, legal and employee benefits issues food and drink sector clients face.

Our solutions include:

  • Full security review and advice on reducing exposure to security risks
  • Cost effective solutions to manage food safety, health and safety, labelling and advertising and employment law risks
  • Business continuity planning
  • Specialist management liability insurance including cover for employment disputes, health and safety investigations, official investigations, and disputes between partners as well as shareholders
  • Insurance placement for all key risks
  • Full disaster recovery service including claims assistance in the event of a loss
  • Valuations and asset tracking
  • Staff absence management
  • Pensions automatic enrolment services
  • Employee benefit programmes (EAPs) and health screening

Marine, Freight & Logistics

We specialise in providing innovative insurance solutions to the marine, freight and logistics sector including businesses that service this sector. We conduct in-depth insurance reviews enabling us to offer tailored solutions, concentrating on protection of assets and liabilities at competitive premiums.

Freight Forwarders and Logistics Operators

We provide comprehensive insurance solutions to cover the client's liability for loss or damage to customers' goods. As associate members of BIFA our policy wording meets with their requirements, and covers for loss or damage to goods in accordance with liability under trading conditions with errors and omissions included as standard.

The wording is specifically tailored for the client's needs which is important in what can be such a highly complex area. We are able to provide expert knowledge of trading conditions with access to specialist legal advice and use of highly experienced claims handlers.

In addition to the above we are also able to arrange an open cargo facility in which the client can provide to his customer an option to insure worldwide sendings on an ‘all risks' basis as per the standard marine clauses. Policies can be arranged online enabling the client to provide terms to their customer in a fast and efficient manner whilst minimising administration costs and time.

Haulage and Warehousekeepers

We provide policy wordings for road hauliers, warehouse keepers, couriers and logistics operators to cover their legal liability for loss or damage to goods whilst in their care, custody and control, in accordance with their conditions of carriage.

The standard wording has no restrictions or exclusions regarding types of goods carried and includes errors and omissions, consequential loss, all risks cover on third party containers and/or trailers and drivers' personal effects. Physical loss or damage to owned and/or leased trailers, containers and similar handling equipment can be included. Policies can be extended to include any enhanced contracts undertaken.

Cargo and Stockthroughputs

Cargo policies can be arranged to cover movement of own goods on a worldwide basis on individually tailored policies to reflect the client's needs.

Stockthroughput policies may be more suitable to those clients who are involved in both the transit and storage of their goods which can all be arranged under one policy, providing them with seamless cover under one simple to administer and cost-effective policy, with one insurer.

Policy wordings are tailored to meet the client's individual requirements but as standard they will include exhibition and/or demonstration risks as well as samples or spares in representative's vehicles. They will also include returned goods, debris removal, buyers and sellers interest contingent cove and storage at any location including own, third parties and retail outlets.

Property Owners

Lucas Fettes & Partners manage a property account with sums insured approaching £3billion and are closely involved with both the property owner and their managing agents.  Our clients include property investors, property developers, property managers, chartered surveyors and sovereign wealth funds.

Lucas Fettes & Partners take the time to understand the specific needs of every client so we can deliver a the right solution. We have agencies with 300+ insurers and are an accredited Lloyd’s broker placing UK and international business, and our long-standing relationships in the underwriting market ensure we are ideally placed to meet today’s demands for consistent high quality and excellent service.

Our style is marked by a creative and personal approach to solving the often complicated problems and needs of our clients.  We maintain a high profile with our clients through regular review meetings.  It is this level of service which has developed our business to the point where major public companies are appointing us in preference to the larger national brokers where access to such levels of expertise and authority is not readily available nor encouraged beyond the initial promotional meetings.

Ultimately, we at Lucas Fettes & Partners believe a client's sense of security in their insurance arrangements derives much from their confidence in both their Insurance Broker and Insurer.

Property Cover

In general, the property market as a whole, offers comprehensive commercial "all risks" cover for the majority of property risks. Through its excellent relationships with underwriters, Lucas Fettes & Partners are in a strong position to obtain comprehensive, often bespoke, policy wordings, including numerous extensions in cover, which benefit both the property investor and property manager, above and beyond that provided by a standard property owners insurance policy.

Lucas Fettes Property Binder

We have a delegated authority scheme with RSA which enables us to quote for and agree cover for small to medium sized property risks. We have negotiated a bespoke wording and all policy documentation is issued from our London office on RSA headed paper. Rates are very competitive and the cover provided is excellent.

Captive Insurance Companies

We also have access to companies specialising in the creation and management of Captive, Mutual and Protected Cell insurance companies. We can work with you to advise upon and assist with the creation of Captive Insurance Vehicles.

A Captive Insurance Company is, in its purest form, a wholly owned subsidiary company formed to reinsure the risks of its parent and associated companies.  A Captive Insurance Company insures all or part of the risks of its owners, the owners being individual companies or groups.  Captives are usually formed to provide alternative risk management solutions to that of the conventional insurance market.

Insurance subsidiaries of large corporations were the forerunners of the captive movement.  The first captives can be traced back to the early 1930's, for example the Blackfriars Insurance Company was formed in 1937 by Unilever.  There are now approximately 5,000 Captive Insurance Companies worldwide.  Most of these captives are domiciled in tax attractive locations, where the regulatory framework is such that regulators may prompt decisions and where capitalisation requirements are commensurate with the risk assumed.

The underlying reason for the formation of a captive is that the conventional insurance market fails to adequately meet the needs of the company purchasing insurance.  A Captive provides the following benefits to its owners:

  • The insurance process is controlled and managed by the insured and not the insurance market.
  • Underwriting profits are retained for the benefit of the insured.
  • Investment income can be derived from premiums and claims reserves until they are required to be paid out.
  • Reduction of market cycles. Good underwriting experience recognises the reinsurance market and premiums are commensurately lower.
  • Insurance costs are controlled by the Insured.
  • Access to expanding capacity.
  • Considerable cash flow advantages.
  • Difficult risks can be insured.
